I'd never shoot someone running away PERIOD. If they're in your home, they are a threat PERIOD. I'd never try restraining the person until the authorities get there. Too many variables and all you're doing is giving the guy an opportunity to disarm you.

Also, if you do decide to use your gun, shoot to kill. This will ensure there is one side of the story; yours.  If his family sues you after the fact, counter sue for attorney's fees + emotional suffering their relative put you through.

As the saying goes "Better to be judged by 12 than carried by 6".

And for those living in liberal states, move to the South where you can actually 'Stand your ground' and not have to find an escape route out of your home.
