Don't think it would be illegal, but I wouldn't want to be spraying it into my local water. You can buy a bottle of scent at walmart for $6. I would suggest you look for the paste type, it will hold on better. 

I see absolutely no reason why your contraption wouldn´t catch fish.

 

If I showed you some of the baits I use that are absolutely deadly and just by looking at them you wouldn´t believe they are fish catchers.

Those aren´t easy to find but here´s a solution that works equally well.
