NY residents (speeding tic ?)

Featured Replies

I am driving through NY on vaca and got pulled over for 25 over limit. My questions are is there a good drivers statue in NY? And also how does the point system thing work. I was trying to research how to approach the tic but didn't get far. Also how much is this tic gonna approximately run me. Any help is greatly appreciated

Your license probably would have got pulled if you were in cali!

Glad I wasn't there. I haven't had a tic in like 6 yrs. In RI that gets you a pass on your next tic but it starts from zero. Hence the good driver statue.

for 25 over the limit, you should get a ticket.

Didn't say the ticket wasn't deserved. I was wondering if NY has a good driver statue. But I appreciate your intelligent input.

I'm not from NY I was just trying to understand what may or may not apply in comparison to RI traffic laws. P.S. I'm on vaca I looked for about 30 min I'm not gonna sit in front of a computer on my trip.

Feel lucky you didn't get a reckless driving ticket.  As far as I've been led to believe there is now a national data based and a ticket in any state will appear on your record, that wasn't always the case.  Back in the days when I got tickets, haven't one in 10 years, I always fought them, do not let the judicial system intimidate you.

Being in RI New York isn't that far away, I think it's worth the trip.  You can  plead guilty, guilty with an explanation or not guilty and cross examine the officer.  Most likely you will lose, but you may get a reduced violation or probation ( no ticket for a year and it's dismissed ).  Your at the mercy of the judge or maybe a plea bargain with the Prosecuting Attorney before your case is tried.

Your insurance company may go down hard and maybe cancel you, especially if other moving violations on your record, they go back 4 or 5 years not 2.

Unless I'm mistaken, not all states have reciprocal agreements to exchange info.  Many do.

Don't know how the points system works in RI, but your best bet is to check with a lawyer that handles traffic citations.

It may cost you three to five hundred dollars, but the fine and surcharges over a few years can cost you thousands.

Your insurance company can tell you how that ticket will impact your insurance costs.

Lawyers who specialize in this field know how best to handle these things in an appeals hearing.

Not only may it get you off the hook, but it can possibly not go on your record.  The fine is the least of it.

You'll need a lawyer who practices in the jurisdiction where you got stopped.  Yellow pages online, then make a few calls.  You should be able to explain your situation for no fee.  A lawyer will explain your chances and tell you his fee to handle it.

Sometimes they can handle it without an appeal, but it is usually better to appear.

The biggest problem you have is that cash strapped towns and cities look to increased traffic enforcement to supplement revenues.

Good luck.  Let us know how you make out.

Be sure to talk to a lawyer before submitting any money for a fine.  Your time to appeal is usually limited, so get on it right away.

Insurance company first to find out how it will impact your premium.  Then check with a lawyer.  Be sure to factor in the cost and time it will take for you to appear should you appeal.

Friend got one in Philly for 20mph over. It cost him around 2800 to keep from losing his license in NC.

I think it's going to depend on who the issuing agency is. If it was a local authority and it's paid, they may not post it, if it was a state trooper, paid or not, most likely it will be posted in the national data base. Other states and there local authorities may not necessarily check the national data base unless that agency's SOG's require it or they have reason to dig deeper..........It's a crap shoot. Either way, most insurance companies will be checking the national data base; again, what the insurance company finds will depend on what information the issuing authority has posted. I think this is pretty close to how it goes.

Thanks for the sincere response.  I have already contacted my insurance comp now I will find a lawyer. Like I said I don't deserve to get away with anything I just don't want to get raked over the coals either.
