Panhandle burglar dead: His gun was fake, homeowner's gun real

BRISTOL

Authorities say a burglar with a fake gun was shot and killed by a Panhandle homeowner with a real gun.

The Liberty County Sheriff's Office reports that 24-year-old Octavious Barnes broke into 82-year-old Bradley Harvil's home and tried to steal about $1,100 in cash Sunday night. Authorities say Barnes was waiving around a toy pistol, colored black with a marker to look real, and assaulted Harvil.

The homeowner was able to get to his real .357 magnum and shot Barnes in the chest and in the eye.

Authorities later concluded that three women had helped Barnes plan the burglary. Deputies have charged 19-year-old Jessica Nicole Long, 22-year-old Heather Marie Ammons and 43-year-old Mandy Allen with felony home invasion and second-degree murder.

wow, another dumb criminal. I'm glad to see that the women were charged with the home invasion and murder.

 Another one bites the dust.

Great story. We need more of the idiots to think like that. At least we won't have to feed and clothe him. Sadly, the three women will hang around the system for years leeching off anything available.

Guys, I can't believe what I'm reading in this thread. The robber was the victim, don't you see? He had a TOY gun! He grew up in such a bad environment and with such bad odds of success that the only way he could survive was to steal. Poor thing. We need to help these people!

The robber was a fool who made 2 mistakes, became a robber, and attempted armed robbery with a toy.

Another story to reinforce the vitality and power of the 2nd Amendment!

I'll make you a bet he's probably got at least three kids out there somewhere......

This guy should be given a medal. I love to see the good guys win.

Rock on

why were the girls charged with second degree murder?

They were part of a felony conspiracy that resulted in a death. Mandatory murder charge.

Good to get this p.o.s. out of the gene pool.

yeah, second degree murder is when someone is killed in the commission of another crime. In this case, the crime was conspiracy to commit armed robbery. The girls were part of the conspiracy so the death in the process is also attributable to them.

Not to get political or anything, but why exactly does he deserve a medal?  He killed an unarmed man.  Sure, the other man was robbing him and the man had the right to defend himself, but he still killed someone.

No, he killed an armed man.  Homeowner had no way of knowing the gun was fake and I believe the law recognizes that.  That's why they put the orange markings on toy guns, to distinguish them from real guns.  When the criminal altered the gun, he changed the status from fake to real.

EXACTLY... as far as the law is concerned he was armed, just like if you are found concealing a toy weapon by a law enforcement officer, it still seems real in the situation

As far as I am concerned the world is now a better place without this scumbag. This is what is wrong with our world today. There is no accountability for actions. This guy broke in with what appeared to be a gun. He deserved everything he received. Personally gun or no gun,you break into a house to rob or harm somebody you deserve to be killed. Eventually there would be no more break-ins.

 Are you serious ????????

* Long sigh*  Regardless of anything else, Mr. Harvil will still be subject to a full investigation.
