Classic bully. He threatens he's going to do this, and he's going to do that, in the hopes that you'll believe him because he never will. Attorneys will work with you, so that when you win (and you will), the bully will have to pay all fees, including your attorney. You'll win access plus a potential restitution, and it won't cost you anything. In the mean time, report him to the local sheriff, and also file a restraining order against him. A knock on his door by a pair of armed deputies will show him he's screwed. You're in the driver's seat here, and he knows it. He's scared, and hoping you'll believe his bluffs because that's all he has. Time to go for the kill shot.

Yea...don't wanna be a Debbie Downer, but copyright/tradmark/patent laws don't have anything to do with whether or not you're making any money (that's only a consideration later for penalties/restitution). If you're infringing, you're infringing. It's black-n-white. There's no "if only" clause. If you need clarification on that, then I urge you to consult with an attorney before doing anything that could land you in hot water later.
